Terms of Service

1. Acceptance of terms

By accessing or using With Kind Folk ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of service

With Kind Folk provides a software-as-a-service platform for corporate volunteering programme management, including event creation, participation tracking, impact reporting, and related features. We reserve the right to modify, suspend, or discontinue the Service at any time, with reasonable notice where possible.

3. Account registration

You must register for an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

4. Subscription and payment

Paid subscriptions are billed monthly or annually in advance. All prices are exclusive of VAT unless stated otherwise. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We do not provide refunds for partial periods. We reserve the right to change pricing with 30 days' notice.

5. Acceptable use

You agree not to use the Service to: upload unlawful, harmful, or fraudulent content; attempt to gain unauthorised access to any part of the Service; use the Service in a way that could damage or impair its operation; or resell or sub-license the Service without our written consent.

6. Data and privacy

Our processing of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. You retain ownership of all data you input into the Service. We process that data only to provide the Service and as described in our Privacy Policy.

7. Intellectual property

The Service and all associated software, design, and content are owned by us and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable licence to use the Service during your subscription term. Nothing in these Terms transfers ownership of any intellectual property.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability to you in any 12-month period will not exceed the fees you paid to us in that period.

9. Termination

We may terminate or suspend your access to the Service immediately for breach of these Terms. You may terminate by cancelling your subscription. Upon termination, you will have 30 days to export your data before it is permanently deleted.

10. Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to terms

We may update these Terms from time to time. We will notify you of significant changes with at least 30 days' notice. Continued use of the Service after the effective date of the new Terms constitutes acceptance.
